This Cancellation and Refund Policy has been prepared to inform users about the cancellation, modification, refund and related request procedures applicable to accommodation reservations made through Butikotels.com.
Butikotels.com is an online reservation platform that enables users to browse accommodation properties and make reservations. The accommodation service is provided by the relevant property specified in the reservation. Butikotels.com acts as an intermediary in the reservation process and, within the scope of its business model, collects the reservation price and manages the cancellation and refund processes.
Information about the property providing the accommodation service is set out in the pre-contractual information and contract documents presented to the user during the reservation process.
Cancellation, modification and refund conditions may differ for each property, room type and rate plan.
The specific conditions presented to the user before the reservation is completed include the free cancellation period, any cancellation charges, the terms applicable to non-refundable reservations and any other applicable conditions.
The user is obliged to review these conditions before completing the reservation. Cancellation and refund requests are assessed on the basis of the specific conditions communicated to the user during the reservation process and the applicable legislation.
Cancellation requests may be submitted through the reservation management system provided on Butikotels.com or through the contact channels listed below.
Where a reservation includes a free cancellation option, cancellations made by the specified deadline (date and time) are refunded as provided for in the relevant conditions.
For cancellations made after the free cancellation period has expired, the charges set out in advance in the reservation's specific conditions may apply.
For non-refundable rate plans, no refund may be made in accordance with the conditions clearly communicated during the reservation process. However, rights arising from mandatory provisions of law and from the failure to provide the service properly are reserved.
Upon receipt of a cancellation request, the request is reviewed and the user is informed of its status.
Refunds are assessed in light of the reservation's specific conditions, the time of the cancellation request, the status of service provision and the applicable legislation.
Where a right to a refund arises, the amount to be refunded is determined in accordance with the relevant reservation conditions. Depending on these conditions, this amount may be the full reservation price or the remaining amount after applicable charges have been deducted.
In cases of duplicate charges, erroneous payments, failure to provide the accommodation service or any other situation requiring a refund under the legislation, the necessary steps are taken with due regard to the specific circumstances of the case.
As the platform managing the payment collection process, Butikotels.com reviews the cancellation and refund requests submitted to it and processes the relevant refunds in accordance with the applicable legislation and payment procedures.
For card payments, refunds are, as a rule, made to the card used for the payment. For other payment methods, a method appropriate to the payment instrument used and the relevant payment infrastructure is applied.
Refunds are processed within the timeframes specified in the applicable legislation. The time it takes for a refund to appear in the bank account or on the card statement may vary depending on the processing procedures of the relevant bank and payment institution.
Butikotels.com provides the user with the necessary information regarding the status of the refund. Variations in the processing times of banks or payment institutions do not remove the refund obligations arising from the legislation.
Requests to change the date or length of stay, the number of guests or the room type are assessed subject to the property's availability and the specific conditions of the relevant reservation.
A modification may result in a price difference or an additional charge. If the modification cannot be made, the cancellation and refund conditions applicable to the existing reservation apply.
A modification request becomes final once confirmed by Butikotels.com.
If the user does not arrive at the property on the check-in date specified in the reservation and has not submitted a cancellation request in advance, the no-show provisions set out in the reservation's specific conditions may apply.
In this case, all or part of the price may not be refunded. The applicable provisions are assessed in light of the conditions communicated to the user during the reservation process and the applicable legislation.
If the accommodation service specified in the reservation cannot be provided by the property, the user's request is reviewed by Butikotels.com and the necessary coordination with the relevant property is carried out.
Refund or alternative solution options are determined in light of the circumstances of the case, the relevant contracts and the applicable legislation.
The user's statutory rights to a refund and other legal rights are reserved.
In the event of natural disasters, decisions of public authorities and similar extraordinary circumstances beyond the control of the parties, cancellation and refund requests are assessed with due regard to the specific circumstances of the case, the reservation conditions and the applicable legislation.
The occurrence of an extraordinary circumstance does not automatically give rise to a right to a full refund for every reservation. However, rights arising from the applicable legislation are reserved.
Accommodation services that must be provided on a specific date or during a specific period may be subject to the exception to the right of withdrawal under subparagraph (g) of paragraph 1 of Article 15 of the Regulation on Distance Contracts (Mesafeli Sözleşmeler Yönetmeliği).
Accordingly, whether the general fourteen-day right of withdrawal applies to accommodation reservations for specific dates is assessed in light of the nature of the service and the applicable legislation.
The exception to the right of withdrawal does not remove the cancellation rights committed to under the reservation, the rights arising from the failure to provide the service properly or any other rights of the consumer arising from mandatory legislation.
No provision of this policy may be interpreted as limiting the rights the consumer has under the applicable legislation.
